GTC– GENERAL TERMS OF USE

  1. Purpose of the General Terms of Use

These General Terms of Use (hereinafter “GTC”) are intended to define the terms under which any user accesses and uses the Nematek Solutions website, available notably at nemateksolutions.com and all its extensions, modules, subdomains, or associated interfaces (hereinafter “the Site”). By accessing or using the Site, the user acknowledges having read, understood, and unreservedly accepted these GTC. If the user does not accept these conditions, they are invited to immediately cease any use of the Site.

  1. Description of the Site and its features

The Site is intended to present the activities of Nematek Solutions, its professional services in IT, cloud, cybersecurity, DevSecOps, Odoo and consulting, its training offer, as well as its online store dedicated to the sale of new or refurbished IT equipment and accessories. The Site may also include contact forms, quote requests, appointment booking modules, educational spaces, informational or technical resources, as well as any additional functionality that Nematek Solutions may deploy in the future.

  1. Access to the Site and availability

Access to the Site is entirely free, excluding connection, equipment, and Internet access costs, which are the sole responsibility of the user. Nematek Solutions strives to ensure maximum availability of the Site but cannot guarantee continuous, uninterrupted, or error-free access. Access to the Site may be temporarily or permanently suspended, without notice or compensation, in case of maintenance, technical evolution, incident, force majeure, or any other circumstance beyond the control of Nematek Solutions. The user acknowledges that Nematek Solutions cannot be held responsible for the unavailability of the Site, regardless of the cause.

  1. User obligations and responsibilities

The user agrees to use the Site fairly and in accordance with applicable laws. In particular, they shall not:

  • use the Site for fraudulent, unlawful, malicious, or public order–contrary purposes;
  • intentionally or unintentionally introduce viruses, malware, overloads, or any action aimed at disrupting the proper functioning of the Site;
  • access protected areas, accounts, data, or servers without prior authorization;
  • collect or extract data from the Site for commercial purposes without written authorization from Nematek Solutions;
  • infringe the intellectual property rights of Nematek Solutions or third parties.

Any violation may result, without prejudice to legal proceedings, in the immediate prohibition of access to the Site.

All elements present on the Site, including texts, logos, images, icons, illustrations, videos, documents, interfaces, software, or any other content, are protected by intellectual property laws and constitute the exclusive property of Nematek Solutions or third parties who have authorized their use. Nematek Solutions undertakes to protect data in accordance with international security standards.

  1. Limitation of liability

Nematek Solutions makes every effort to ensure the reliability of the information published on the Site. However, inaccuracies, errors, or omissions may occur. Consequently, Nematek Solutions declines all responsibility in case of:

  • errors or omissions in the content;
  • damages resulting from access to or use of the Site;
  • interruptions, breakdowns, viruses, cyberattacks, or any malfunction beyond its control;
  • non-compliant use of the Site by the user.

Nematek Solutions shall in no event be held liable for indirect damages, operating losses, data losses, or intangible harm.

  1. Applicable law and jurisdiction

These GTC are governed by the laws of the Republic of Cameroon. In case of dispute, exclusive jurisdiction is granted to the courts of Douala or Yaoundé, unless otherwise provided by law.
